Terms and Conditions

Article 1: General provision

The e-commerce website of Asiabel, a limited partnership with registered office at Harenstraat 37C, 3840 Borgloon, Belgium, VAT BE-0483466072, RPR Tongeren, (after referred to as Asiabel) offers its customers the possibility to order the products from its webshop online to buy.

These Terms and Conditions ("Terms") apply to any order placed by a visitor to this e-commerce website ("Customer"). When placing an order via Asiabel's web shop, the Customer must expressly accept these Terms and Conditions, thereby agreeing to the applicability of these Terms and Conditions, to the exclusion of all others terms and conditions. Additional conditions of the Customer are excluded, unless they have been accepted in advance, in writing expressly by Asiabel.

Article 2: Price

All stated prices are expressed in EURO, always inclusive of VAT and all other duties or taxes that are required to be paid by the Customer.

The indication of price refers exclusively to the articles as described verbatim. The accompanying photos are decorative and may contain elements that are not included in the price.

Article 3: Offer

Despite the fact that the online catalog and the e-commerce website have been compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors or is not up-to-date. Obvious mistakes or errors in the offer do not bind Asiabel. Asiabel is only bound by an obligation of means with regard to the correctness and completeness of the information provided. Asiabel is under no circumstances liable in the event of manifest material errors, typesetting or printing errors.

If the Customer has specific questions about, for example, sizes, color, availability, delivery time or delivery method, we request that the Customer contact us in advance via the email address info@asiabelmart.be

The offer is always valid as long as stocks last and can be adjusted or withdrawn by Asiabel at any time. Asiabel cannot be held liable for the availability pf a product. If an offer has a limited period or validity or is subject to conditions, this will be explicitly stated in the offer.

Asiabel has the rights to sell all items listed under the business unit data.

Article 4: Online purchases

Order process

The order is created by reserving the selected products in the shopping cart. After that, the Customer has the choice to continue shopping or to pay. Via the button 'Continue with payment' you enter the processing process before you have completed an order:

1. Personal data: if desired, the customer can fill in his data by creating an account or paying as a guest. The 'Continue' button takes you to the window address window.

2. The Customer must fill in the shipping address. The 'Continue' button takes you to the payment window.

3. The Customer selects the shipping method; this is either home delivery or pick up yourself. Via 'Continue' you end up in the payment window.

4. The Customer chooses the payment method and must agree to the general terms and conditions and the right of withdrawal. By clicking on 'Order and pay', the order is finalized.

After payment, the Customer will receive an email confirming the order and receipt of payment. A track and trace email is also automatically sent via the shipping company so that the Customer can follow up his order.

Product information

The Customers have the possibility to obtain product information via:

  • The website itself. Information is shown per product about the content and, if applicable, also for which type of dishes it can be used.
  • By email. The Customer can always send an e-mail for more product information. We try to answer the Customer's question within 1 working day.

Status of the order

Once the Customer has ordered, he will automatically receive an email that the order is being processed. If the order is actually sent, the Customer will receive a tracking e-mail via the sender on which the order can be followed up.

Regardless of the payment method, you always have the option to request an invoice. For sales to professional customers, please contact us instead of ordering via the website.

Asiabel is entitled to refuse an order (in writing), as a result of a serious shortcoming by the Customer with regard to the order or any other order or agreement in which the Customer is involved.

Article 5: Delivery and execution of the agreement

Articles ordered through this web shop are delivered in the European Union to the Customer's home or to a collection point of your choice.

Delivery modalities: Asiabel send the products – after receipt of your payment. Shipments are made twice a week, on Monday and Wednesday. Asiabel can expand this further.

Delivery is made by shipping via the shipping company (Bpost, Post NL, GLS, Mondial Relay, DHL). Standard delivery at home or collection point in Belgium 3-4 working ays and other EU countries between 5-7 days.

Asiabel cannot be held responsible for force majeure, strike or delay of the shipping company. Asiabel will always try to inform Customers about delays via the shipping company.

Any visible damage and/or qualitative shortcoming in the delivery must be reported to Asiabel by the Customer without delay.

The risk of loss or damage passes to the Customer as soon as he (or a third party designated by him, ho is not the carrier) has acquired physical possession of the goods. However, the risk already passes to the Customer upon delivery to the carrier, of the carrier has been instructed by the Customer to transport the goods and this choice was not offered by Asiabel.

Inquire in the event of non-delivery

If an order has not been delivered, we will follow up with the sender (Bpost, Post NL, GLS, Mondial Relay, DHL). The Customer will normally receive the order again, the costs od the lost product will be recovered from the sender.

Incorrect delivery

If the wrong or too few products are delivered in a new order. Depending on the cost price of the products, the Customer can keep them or return them.

Damaged products

If a product is damaged, it will be delivered to the Customer free of charge in a subsequent order. The costs will then be recovered from the sender if it appears that the packaging itself has been done correctly.

Late delivery

This option is included in the general terms and conditions. The sender cannot guarantee 100% that delivery can always be made the next working day. The Customer can also follow the tracking site at any time to see at any time to see when the delivery will arrive.

Article 6: Retention of title

The delivered articles remain the exclusive property of Asiabel until the moment of full payment by the Customer.

The Customer undertakes, if necessary, to point out Asiabel's retention of title to third parties, e.g. to anyone who would have seize items that have not yet been fully paid for

Article 7: Right of withdrawal

The provisions of this article only apply to Customers who purchases articles online from Asiabel in their capacity as consumers.

If the right of withdrawal applies:

The customer has the right to withdraw from the agreement within a period of 14 calender days without giving reasons. This is only valid for goods that are unopened (type 'dry food' with a THT date).

The withdrawal expires 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, acquired physical possession of the last shipment or the last part.

To exercise the right of withdrawal, the Customer must inform Asiabel (email: info@asiabel.com) of his decision to withdraw from the contract by means of an unequivocal statement. After the withdrawal, the Customer will receive an email explaining in detail the instructions on how to return the products. Asiabel will make every effort to offer other products or to make an arrangement with regard to the refund, but the return of the products is always at the expense of the Customer.

To comply with the withdrawal period, the Customer must send his communication concerning his exercise of the right of withdrawal before the withdrawal period has expired.

The Customer must return or hand over the goods immediately, but in any case no later than 14 calendar days after the day on which he communicated his decision to withdraw from the contract to Asiabel, to the shipping company that Asiabel will notify at that time. The Customer is o time if he sends back the goods before the period of 14 calendar days has expired.

Unopened and undamaged goods of the dry food type with best before date may always be returned free of charge to Asiabel (Harenstraat 37C, 3840 Borgloon), only after a clear appointment for a specific date and time with Asiabel.

The direct costs of returning the goods shall be borne by the Customer. The costs are paid to the shipping company.

If the returned product has diminished in value in any way, Asiabel reserves the right to hold the Customer liable and claim compensation for any depreciation for the goods resulting from the use of the goods by the Customer that goes beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Only articles of the dry food type with best before date that are in original packaging, together with all accessories, instructions for use and invoice or proof of purchase can be taken back.

If the customer revokes the agreement, Asiabel will refund all payments received from the Customer up to that point, excluding the standard delivery costs, to the Customer within a maximum of 14 calendar days after Asiabel has been informed of the Customer's decision to terminate the agreement. In the case of sales agreements, Asiabel may withhold reimbursement until it has receives all the goods back, or until the Customer has demonstrated that it has been returned the goods, whichever comes first.

Extra costs resulting from the choice of the Customer for a return shipment will not be reimbursed by Asiabel.

Asiabel will reimburse the Customer with the same means of payment as the Customer used for the original transaction, unless the Customer has expressly agreed otherwise; in any case, the Customer will not be charges any costs for such reimbursement. Asiabel pays the customer the full amount of the returned goods that meet the type of dry food with the best before date, with the exception of the shipping costs incurred by returning the goods.

The Customer cannot exercise the right of withdrawal for:

  • The delivery of goods manufactured according to the Customer's specifications , or which are clearly intended for a specific person;
  • The delivery of goods that spoil quickly or with a limited shelf life;
  • The delivery of sealed goods that are not suitable to be returned for reasons of health protection or hygiene and of which the seal has been broken after delivery;
  • The delivery of goods which, due to their nature, are irrevocably mixed with other products after delivery;

Article 8: Force majeure

In case of force majeure, we are not obliged to fulfill our obligations. In that case, we can either suspend our obligations for the duration of the force majeure, or dissolve the agreement definitively.

Force majeure is any circumstance beyond our will and control that prevents the fulfillment of our obligations in whole or in part. By this we understand, among other things, strikes, fire, business failures, power failures, failures in a (telecommunication) network or connection or used communication systems and / or the unavailability of our website at any time, non-delivery or late delivery of suppliers or other engaged third parties, …

Article 9: Penalties for non-payment

Without prejudice to exercise of other rights Asiabel has, in the event of non-payment or late payment from the date of the default, the Customer owes interest of 10% per year on the unpaid amount by operation of law and without notice. In addition, the Customer is legally and without notice liable to pay a fixed compensation of 10% on the amount concerned, with a minimum of 25 euros per invoice.

Without prejudice to the foregoing, Asiabel reserves the right to take back the not (fully) payed items.

Article 11: Affected validity – non-renunciation

If any provision of these Terms is declared invalid, illegal or void, this will not in any way affect the validity, legality and applicability of the other provisions. The failure at any time by Asiabel to enforce any of the rights listed in these Terms, or to exercise any right thereof, shall never be considered a waiver of such provision and shall never affect the validity of such rights.

Article 12: Change of conditions

These terms and conditions are any time without prior notice. When placing the order, the Terms and Conditions will apply as they were at the time the sale was concluded. Any order placed after changing or supplementing the general terms and conditions implies acceptance of these new supplemented terms and conditions.

Article 13: Evidence

The Customer accepts that electronic communications and back-ups can serve as evidence.

Article 14: Applicable law – Competent court

Belgian law applies. The courts of the Asiabel's place of residence are competent in the event of legal disputes.
